From 1 October 2020, the Department of Home Affairs have introduced new labour market testing (LMT) criteria.
Currently, if not exempt from LMT requirements, employers must publish the nominated position on at least two (2) separate recruitment website platforms for at least 28 days within the previous 4 months, before submitting a TSS nomination application.
From 1 October 2020, employers who are not exempt from the LMT criteria must publish an advertisement on at least three (3) separate recruitment website platforms, and at least one of those recruitment website platforms must be the government version known as JobActive.
Further, we are seeing JobActive take several days to publish the advertisement once a request is sent to them. If you are an employer seeking to hire an overseas national who has an imminent visa expiry deadline, it is critical that the LMT requirements be reviewed and sorted urgently.
