A subclass 457 visa holder's salary rate can increase during their visa period and indeed, it should, if the market salary rate increases during this time. That is, their salary should remain no less than what an equivalent Australian worker would receive to do equivalent work in the same location.
If this does not occur, the sponsor will be in breach of regulation 2.79(2). As a general rule, unless a subclass 457 visa holder is paid a salary of $250,000 or more, their salary cannot decrease during their visa period below what was approved in their most recent nomination, even if the market salary rate decreases during this time – otherwise, the sponsor will be in breach of regulation 2.79(3). Such a breach could occur if, for example, the sponsor reduces the visa holder's hourly rate or increases their work.
