4. Have you considered a 402 visa for applicants ineligible for a 457 visa?

The 402 visa can be very useful to employers for assisting proposed applicants who cannot meet the skill requirement for the 457 visa.

Basic requirements for the 402 visa include the following:

• an organisation will need to be nominating a person to participate in a work-based training programme
• the nominated occupational training is:
  • a structured workplace training program; and
  • specifically tailored to the training needs of the identified visa holder or applicant; and
  • of a duration that meets the specific training needs of the identified visa holder or applicant
• the nominated occupation to which training relates is on the current Consolidated Sponsored Occupations List
• the applicant must be paid the legal minimum rate of pay for the type of work they are doing, along with other minimum employment entitlements
• the identified visa holder or applicant has the equivalent of at least 12 months full-time experience in the occupation to which the nominated occupational training relates in the 24 months immediately preceding the time of nomination
• the identified applicant has appropriate English language skills to undertake the nominated occupational training.
